Welcome to the E-Filing Portal of the Appellate Tribunal for Electricity (APTEL). These Terms and Conditions govern access to and use of the portal. By accessing or using the portal, users are expected to comply with these terms, applicable laws, relevant Tribunal rules, practice directions and instructions displayed on the portal.

Please read these terms carefully before using the portal. If you do not agree with the applicable terms, you should discontinue use of the portal, except where access is necessary to review applicable official information or comply with a legal requirement.

1. Purpose and Scope

The portal is intended to provide online access to the e-filing facilities made available by APTEL. Its available features may include account registration, entry of filing details, document submission and access to related information, as enabled by the portal.

The availability and use of any facility are subject to the applicable statutory provisions, procedural requirements, technical conditions and official directions issued by the competent authority.

2. Eligibility and User Registration

Users must satisfy the eligibility, identity and authorisation requirements applicable to the service they intend to use. Registration does not by itself establish a right to file a particular matter or guarantee acceptance of a filing.

  • Provide complete, accurate and current registration details.
  • Provide additional information or verification when lawfully required.
  • Ensure that any representative is duly authorised to act for the relevant party.
  • Update account information when required by the portal's procedures.
  • Do not create accounts using another person's identity or details without proper authority.

  • Maintain the confidentiality of passwords and authentication details.
  • Log out after using the portal on shared or public devices.
  • Notify the designated support channel if unauthorised access is suspected.
  • Do not attempt to access another user's account or restricted portal resources.

Actions performed through an account may be subject to verification and audit in accordance with applicable law and authorised government procedures.

4. Filing Information and Documents

Users must ensure that information entered and documents uploaded through the portal are accurate, complete, legible and relevant to the filing being submitted.

  • Enter correct case, party and representative details.
  • Upload documents in the formats and within the limits permitted by the portal.
  • Ensure that documents are complete and properly prepared for submission.
  • Ensure that required signatures, certifications, authorisations and supporting documents are provided where applicable.
  • Do not knowingly submit false, misleading, forged or unauthorised material.
  • Retain copies of submitted documents and any acknowledgement provided.

Users remain responsible for ensuring compliance with the applicable filing requirements and directions.

5. Submission, Acknowledgement and Acceptance

Submission of information through the portal does not necessarily mean that a filing has been scrutinised, accepted, registered or taken on record by the Tribunal.

A filing may be subject to scrutiny, correction, additional documentation or other procedural requirements in accordance with applicable rules and directions. Users should monitor official communications and respond within any applicable time limits.

Users should retain any acknowledgement or reference number generated by the portal. In case of doubt about the status or legal effect of a submission, users should consult the applicable official instructions or designated support channel.

6. Compliance with Laws and Tribunal Directions

Use of the portal does not exempt any person from complying with applicable legislation, procedural rules, filing deadlines, fees, prescribed formats, practice directions, orders or other requirements imposed by the Tribunal or a competent authority.

Where these terms are inconsistent with applicable law or a binding direction of the Tribunal, the applicable law or binding direction shall prevail to the extent of the inconsistency.

7. Acceptable Use

Users must not:

  • Use the portal for unlawful, fraudulent or unauthorised purposes.
  • Submit knowingly false, misleading, malicious or unlawful content.
  • Attempt to bypass access controls or interfere with portal security.
  • Introduce malicious software, harmful code or unauthorised scripts.
  • Disrupt the availability or normal operation of the portal.
  • Access, collect or disclose information without appropriate authority.
  • Misuse the portal in a manner that violates applicable law or the rights of others.

Suspected misuse may be examined and handled in accordance with applicable law and authorised procedures.

8. Privacy and Personal Information

Personal information provided through the portal may be processed for registration, authentication, filing administration, user support, security and other authorised purposes, subject to applicable law and the relevant privacy policy.

Users should avoid including personal or confidential information unless it is required for the filing or requested through an authorised process. Information submitted as part of legal proceedings may be handled in accordance with applicable law, Tribunal procedure and relevant disclosure requirements.

Please also refer to the portal's Privacy Policy for further information about information handling, where published.

9. Availability and Technical Issues

Reasonable efforts may be made to keep the portal operational and accessible. However, uninterrupted availability cannot be guaranteed. Access may be affected by maintenance, upgrades, connectivity issues, security measures, technical failures or circumstances beyond the portal administrator's control.

Users should not assume that a failed or interrupted transaction has been completed. They should verify the submission status and retain available evidence of the transaction.

Where a technical issue affects a filing or deadline, users should follow the applicable Tribunal directions and contact the designated support channel promptly. Any relief or extension remains subject to the competent authority's applicable rules and decision.

10. Intellectual Property and Official Content

Unless otherwise stated, the portal's design, layout, software, text, graphics and other materials may be subject to applicable intellectual property rights or government usage conditions.

Users may access and use portal content for lawful purposes connected with the portal's intended services. Reproduction, alteration or redistribution of material must comply with applicable law, permissions and any conditions stated with the material.

11. External Links

The portal may provide links to external websites for user convenience or access to related information. External websites may be governed by their own terms, privacy policies and security practices.

The inclusion of an external link should not, by itself, be interpreted as an endorsement of all content or services on that website. Users should exercise appropriate care when accessing external websites.

12. Limitation and Disclaimer

Portal information and facilities are provided to support the services made available online. While reasonable care may be taken to maintain information, users should verify requirements against the applicable official laws, rules, notifications, orders and directions.

Nothing on the portal should be interpreted as legal advice, a decision on the merits of a matter, or a waiver of any statutory requirement. Nothing in these terms limits any responsibility or obligation that cannot lawfully be excluded.

13. Changes to These Terms

These terms may be revised when required to reflect changes in applicable law, Tribunal procedures, portal functionality or government policy. Updated terms will be published on the portal where appropriate.

Users should review the current version periodically. Any revised terms will apply subject to applicable law and relevant official directions.

14. Governing Law and Jurisdiction

These terms are to be read in conjunction with the laws applicable in India and the statutory framework governing the Tribunal. Questions concerning jurisdiction, procedure or the legal effect of a filing shall be determined in accordance with applicable law and binding directions of the competent authority.

15. Help and Contact

For technical assistance with registration, login or available portal facilities, users may consult the published user manual or contact the designated portal helpdesk.

Technical support does not replace legal advice or official directions concerning filing eligibility, limitation periods, procedural compliance or acceptance of a matter.
